When the auction ends, am I the owner of the property?
Not yet. AuctionEU must communicate to you that your offer has been accepted and it has exceeded the reserve price. Then a preliminary contract must be signed during a specific meeting with one of our representatives, and the deposit paid no later than 3 working days from the date of the acceptance of your offer (the draft is available in the Attachments section on each property page). Finally, the closing will be performed before a notary public.
How long after the end of the auction should I pay the deposit?
Shortly after the end of an auction, the highest bidder will be informed if the offer has been accepted. The procedure requires the winner to sign the preliminary sales contract during a specific meeting with one of our representatives and to pay the deposit within no later than three (3) working days from the date of acceptance of the proposal. The draft contract is already available on the corresponding property page.
Can I sign the preliminary agreement although I have not received a mortgage offer?
Yes, the preliminary contract must be signed conditional to successfully obtaining a mortgage, for the amount included in the preliminary agreement. Should the mortgage fall through, the agreement will be void.
When is the deposit, when paid by cheque, be debited?
For preliminary agreements without condition precedents, the cheque is debited at signing of the agreement.
Can I pay the deposit in cash?
No, the deposit must be paid with a special cheque with proof of funds. Please let us know if you require further information.
When should I make the final payment?
The final payment will be done at the date of the closing managed by the notary. The payment can be made by cheque with proof of funds, bank transfer (at least 3 days before closing), money transfer IBRT (instant bank transfer).
Can I pick the notary for the closing?
Yes, you can. During the appointment for the signing of the preliminary and the payment of the deposit with our representative, you will be asked to indicate the name of your notary. If you do not have one available, you can communicate the name later, or appoint one from our list.
Who pays the notary?
It is customary that notary fees are payable by the buyer.
Should I pay agency commissions?
No, you should not. One of the advantages of buying a property on AuctionEU is the total saving of commissions normally allocated to real estate agencies for brokerage.
My offer has been accepted. Can I buy the property jointly with someone else?
Yes, you can. This is allowed pending customary checks.
Can the winning bidder delegate to someone else the property purchase?
Yes, the appointment of the buyer can be made by the date of the notarial deed. However, unless there are different contractual provisions included in the preliminary agreement, since the new buyer must meet the anti-money laundering requirements and the notary must request the necessary documents to instruct the practice, it is preferable that the appointment is communicated to the seller and the notary with at least 5 days of notice with respect to the completion date. In addition, if the proposal or the preliminary contract have been registered, the appointment deed involves the application of the registration tax whose costs are borne by the buyer.
I signed the preliminary agreement and paid the deposit. Can someone else to close the contract and purchase the property?
Yes, the appointment of the buyer can be made by the date of the notarial deed. However, unless there are different contractual provisions included in the preliminary agreement, since the new buyer must meet the anti-money laundering requirements and the notary must request the necessary documents to instruct the practice, it is preferable that the appointment is communicated to the seller and the notary with at least 5 days of notice with respect to the completion date. In addition, if the proposal or the preliminary contract have been registered, the appointment deed involves the application of the registration tax whose costs are borne by the buyer.
I changed my mind and I want my money back.
As stated in the preliminary agreement, in the event of default by the bidder following the signature of the preliminary agreement, the deposit paid will be retained by the Seller pursuant to Article 1385 of the Italian Civil Code.

I have decided not to proceed with the property purchase
As stated in the preliminary agreement, in the event of default by the bidder following the signature of the preliminary agreement, the deposit paid will be retained by the Seller pursuant to Article 1385 of the Italian Civil Code.
